When government entities holding unclaimed assets have tried (if that’s what you accept them calling it) and failed to reach the rightful owners, the assets are set aside for a time period by law. If the assets aren’t properly claimed within the legal timeframe, the government happily keeps it.

As you can imagine, the government entity is reluctant to release assets that they might otherwise keep if a certain time period expires. If they even manage to make the rightful owner aware of their right to these assets, the government entities make claiming these assets by the rightful owners confusing, time-consuming, and unforgiving in the claims process.

We never like seeing money and other assets that belong to individuals legally default to the government because the individuals didn’t know the money existed or how to get it.

Where do these assets originate?

Neither federal nor state law requires government entities holding assets to make these claimable assets known to the general public. Nor is there a requirement for these government entities to make more than a cursory, basic attempt to locate and contact the rightful owners.

What does the recovery process entail?

 

1. Locate assets.

We locate dormant assets and unclaimed funds from a multitude of government sources.

Our team reviews thousands of private and public documents to determine which parties, businesses, individuals, and estates have rights to the assets or funds.

2. Identify and locate owners.

We engage research professionals, skip tracers and private investigators who use every tool available to locate the owners. We also utilize several subscription databases and public record databases.

This is the most time-consuming and costly part of the recovery process and can take from one month to several years.

3. Contact owners.

We attempt to contact the party of interest via a letter (a/k/a “snail mail”). Once an owner interested in claiming the funds responds, we discuss the claim further and determine the most effective way of claiming the funds.

4. Engage our services.

Once a party of interest wishes to become a client of SAH Discoveries, we prepare a simple contingency fee agreement outlining the terms of our representation.

 

5. Document preparation.

Our team prepares all documents, pleadings, declarations and affidavits required to document the rights to the assets or funds.

We’ll then arrange to have the documents delivered directly to you to be executed and returned to our firm.

6. Claim submission.

Once the documents are returned to us, we then assemble the claims package. The package goes through two additional quality control levels before it is filed with the holder of the assets or funds.

A confirmation letter will be sent to you informing of when the claim was submitted and approximately when to expect payment.

7. Communication and follow up.

We receive and answer all correspondences and questions from the asset holders and ensure that all timelines are met. In the rare event that outside legal assistance is required to receive payment, we handle all aspects of the process and advance all expenses.

8. Payment of claim.

We will notify you when the asset holder approves your claim. Once the funds are received, we will forward you your check along with a final accounting statement.
